Welcome to Passionfruit Learning! These Terms & Conditions (“Terms”) govern your use of our web application, so please read them carefully before accessing or using our services. By accessing or using Passionfruit Learning, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.

1. Use of Services

1.1 Eligibility: You must be a high school student or educator interested in computer science education to use our services. By using Passionfruit Learning, you affirm that you meet these eligibility requirements.

1.2 Account Registration: In order to access certain features of Passionfruit Learning, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

1.3 User Conduct: You agree to use Passionfruit Learning only for lawful purposes and in accordance with these Terms. You shall not engage in any conduct that:

(a) violates any applicable law or regulation; (b) infringes upon or violates the rights of others; (c) is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable; (d) interferes with or disrupts the operation of Passionfruit Learning or any servers or networks connected to Passionfruit Learning; (e) attempts to gain unauthorized access to Passionfruit Learning, other user accounts, or computer systems or networks connected to Passionfruit Learning; or (f) introduces any viruses, worms, malware, or other harmful code.

2. Intellectual Property

2.1 Ownership: All content and materials available on Passionfruit Learning, including but not limited to text, graphics, logos, images, software, and other materials, are the property of Passionfruit Learning or its licensors and are protected by copyright, trademark, and other intellectual property laws.

2.2 License: Passionfruit Learning grants you a limited, non-exclusive, non-transferable, and revocable license to access and use our services for your personal, non-commercial use.

2.3 Restrictions: You shall not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content or materials from Passionfruit Learning without the prior written consent of Passionfruit Learning.

3. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and disclose information about you when you use Passionfruit Learning.

4. Score Guarantee & Refund Policy

4.1 Eligibility: Passionfruit Learning offers a money-back guarantee for students who do not receive a score of 5 on their official AP exam, subject to the conditions below. This guarantee applies only to subjects for which Passionfruit Learning provides both Free-Response Question (FRQ) and Multiple-Choice Question (MCQ) practice.

4.2 Conditions: To qualify for a refund under this guarantee, all of the following must be met at the time of the official AP exam:

  • The student's overall predicted score on Passionfruit Learning is a 5;
  • The student has completed at least two (2) full-length practice exams on Passionfruit Learning, and the two (2) most recently completed full-length practice exams each predict a score of 5; and
  • All qualifying practice exams referenced above must have been completed before the official AP exam date for the corresponding subject.

4.3 Refund Process: Students who meet all of the above conditions and do not receive an official AP exam score of 5 may request a refund by contacting us at jason@passionfruitlearning.com. Refund requests must include proof of the official AP exam score (e.g., a screenshot from College Board). Passionfruit Learning reserves the right to verify eligibility using platform data.

4.4 Scope: This guarantee covers the subscription fee paid by the student for the applicable subject. It does not apply to any third-party fees, including AP exam registration fees.

5. Disclaimer of Warranties

Passionfruit Learning is provided on an “as-is” and “as-available” basis without any warranties of any kind, whether express or implied. Passionfruit Learning disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

6. Limitation of Liability

In no event shall Passionfruit Learning, its officers, directors, employees, or agents be liable to you for any indirect, consequential, incidental, special, or punitive damages arising out of or in connection with your use of Passionfruit Learning or these Terms, even if Passionfruit Learning has been advised of the possibility of such damages.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of California, without regard to its conflict of law principles.

8. Changes to Terms

Passionfruit Learning reserves the right to update or modify these Terms at any time without prior notice. Any changes to these Terms will be effective immediately upon posting the revised Terms on Passionfruit Learning. Your continued use of Passionfruit Learning following the posting of any changes constitutes acceptance of those changes.
